Understanding both your <strong>legal obligations<\/strong> and <strong>employee rights<\/strong> is critical to protecting your company and minimizing legal risk.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-understanding-the-law\">Understanding the Law<\/h3>\n\n\n\n<p><strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-green-cyan-color\">Unauthorized Entry &amp; Reentry<\/mark><\/strong><\/p>\n\n\n\n<p>It is a criminal offense for any individual to unlawfully enter or reenter the United States. First-time illegal entry can carry up to six months in prison and fines, while repeat offenses are punishable with up to two years in prison. Reentering with a criminal record can result in felony charges with longer prison terms. <em>(8 U.S.C. \u00a7\u00a71325\u20131326)<\/em><\/p>\n\n\n\n<p><strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-green-cyan-color\">Illegal Hiring Practices<\/mark><\/strong><\/p>\n\n\n\n<p>Employers can face serious penalties for knowingly hiring or harboring unauthorized workers. This includes:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Hiring 10 or more unauthorized workers in a 12-month period (up to 5 years in prison).<\/li>\n\n\n\n<li>Encouraging, transporting, or concealing unauthorized workers (5\u201310 years; up to life if death results).<\/li>\n\n\n\n<li>Bringing workers into the U.S. outside official ports of entry (10\u201320 years; life, if death results).<\/li>\n\n\n\n<li>Knowingly subcontracting for unauthorized labor.<\/li>\n<\/ul>\n\n\n\n<p><strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-green-cyan-color\">Things to Remember<\/mark><\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>It is not a crime to insist that law enforcement officials have proper authorization to search your business. Additionally, you may maintain your right to remain silent.<\/li>\n\n\n\n<li>You should notify counsel immediately upon the arrival of law enforcement officers to assist you and your employees in responding to law enforcement and to protect your company\u2019s rights.<\/li>\n\n\n\n<li>It is not a crime <em>not <\/em>to proactively report aliens that an employer knows, or suspects, are illegally in the United States, as long as the employer is not taking any actions to harbor or support the aliens.<\/li>\n\n\n\n<li>Employers do not have a duty to report foreign nationals unlawfully present, however, they may not continue to employ anyone \u2013 including subcontracted labor \u2013 who lacks work authorization.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-a-step-by-step-protocol-for-workplaces\">A Step-by-Step Protocol for Workplaces<\/h3>\n\n\n\n<p>The following <strong>12-step protocol<\/strong> will help employers and managers navigate ICE visits while remaining compliant and protecting employee rights:<\/p>\n\n\n\n<ol start=\"1\" class=\"wp-block-list\">\n<li><strong>Stay Calm &amp; Professional<\/strong> \u2013 Maintain cooperation without volunteering unnecessary information. Employees have the right to remain silent.<\/li>\n\n\n\n<li><strong>Verify ICE Authority &amp; Warrants<\/strong> \u2013 Request credentials and confirm if a warrant is judicial (signed by a federal judge) or administrative.<\/li>\n\n\n\n<li><strong>Limit Access Without a Proper Warrant<\/strong> \u2013 Only allow entry into public spaces unless a valid judicial warrant grants further access.<\/li>\n\n\n\n<li><strong>Designate a Point of Contact<\/strong> \u2013 Assign a trained representative, preferably HR or legal, to manage all interactions.<\/li>\n\n\n\n<li><strong>Contact Legal Counsel Immediately<\/strong> \u2013 No interviews or searches should proceed without attorney involvement.<\/li>\n\n\n\n<li><strong>Prepare for Joint Agency Actions<\/strong> \u2013 Expect possible inspections from ICE alongside the Department of Labor or state agencies.<\/li>\n\n\n\n<li><strong>Maintain I-9 Compliance<\/strong> \u2013 Keep accurate, up-to-date I-9 forms, separate from personnel files, and respond to Notices of Inspection within three business days.<\/li>\n\n\n\n<li><strong>Mark &amp; Protect Private Areas<\/strong> \u2013 Clearly label areas as \u201cAuthorized Personnel Only\u201d to limit unauthorized access.<\/li>\n\n\n\n<li><strong>Train Staff on Rights &amp; Procedures<\/strong> \u2013 Provide \u201cKnow Your Rights\u201d materials and training on what to say (and not say) during visits.<\/li>\n\n\n\n<li><strong>Document All Interactions<\/strong> \u2013 Record agent names, badge numbers, visit details, and any seized property.<\/li>\n\n\n\n<li><strong>Post-Raid Follow-Up<\/strong> \u2013 Notify legal counsel, assess any overreach, and support affected employees and their families.<\/li>\n\n\n\n<li><strong>Avoid Prohibited Actions<\/strong> \u2013 Do not hide employees, provide false information, retaliate against workers, or interfere with lawful searches.<\/li>\n<\/ol>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-best-practices-to-minimize-risk\">Best Practices to Minimize Risk<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Create a written ICE response protocol with input from legal counsel.<\/li>\n\n\n\n<li>Train all supervisors and front-line employees on these procedures.<\/li>\n\n\n\n<li>Perform regular attorney-led I-9 audits for \u201csafe harbor\u201d protections.<\/li>\n\n\n\n<li>Include immigration compliance clauses in vendor contracts.<\/li>\n\n\n\n<li>Have contingency staffing plans in case employees are detained.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-final-word\">Final Word<\/h3>\n\n\n\n<p>ICE worksite enforcement can be stressful and disruptive, but preparation is your best defense.
