Only FLSA-required overtime premiums and voluntary customer tips qualify; non-FLSA overtime premiums, mandatory service charges, and automatic gratuities must be reported separately as unqualified wages. Employees may also see new informational Box 14 W-2 codes related to 2025 overtime exemptions and deductions, making early employer planning critical to ensure compliance, accurate reporting, and clear employee communication.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-text-color has-vivid-green-cyan-color has-alpha-channel-opacity has-vivid-green-cyan-background-color has-background is-style-wide\"\/>\n\n\n\n<p>Starting in 2026, employers will need to separately track and report \u201cqualified\u201d overtime and tips under the <a href=\"https:\/\/pbspay.com\/news\/2025\/07\/09\/congress-passes-the-big-beautiful-bill-what-do-you-need-to-know\/\"><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-green-cyan-color\">OBBBA<\/mark><\/a> <mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-green-cyan-color\"><\/mark>rules. For overtime, only the FLSA-required overtime premium is eligible for the employee credit\/deduction. So if an employer pays overtime premiums for non-FLSA overtime hours, those amounts must be reported separately because they are not qualified. This amount is only exempt from Alabama state income tax.<\/li>\n\n\n\n<li><strong>Federal Qualified Overtime Deduction (Code: \u201cFLSA OT Prem\u201d)<\/strong><br>This reflects the amount of overtime wages earned in 2025 that may qualify under the Federal Qualified Overtime Deduction provision included in the \u201cOne Big Beautiful Bill Act\u201d passed in the summer of 2025. This is not an exception. It is an informative amount to help support the deduction.
