Rules vary significantly by state, and failing to comply can expose businesses to unnecessary legal risk. Whether your workforce is large or small, understanding what the law requires, and communicating those requirements clearly to employees, is an important part of responsible workforce management.

Voting Leave Requirements Vary by State

Across the country, voting leave laws differ in several key ways. Some states require paid time off, others mandate unpaid leave, and requirements around advance notice, the amount of time granted, and employer discretion all vary. Employers operating in multiple states should review each state’s rules individually, as a one-size-fits-all policy may leave the company out of compliance in at least one jurisdiction.

Alabama’s Voting Leave Law

In Alabama, employees are entitled to take up to one hour off from work to vote in any municipal, county, state, or federal primary or general election, provided they give their employer reasonable advance notice. However, this entitlement comes with an important exception: if an employee’s shift begins at least two hours after the polls open or ends at least one hour before the polls close, no voting leave is required. In those cases, the employee is presumed to have sufficient time to vote outside of working hours.

Employers also retain some control over the process. Under Alabama law, the employer may specify the hours during which the employee takes the leave, allowing businesses to minimize disruption to operations while still meeting their legal obligations.

Additional Requirements for Larger Employers

Alabama employers with 26 or more employees have an added obligation to be aware of. Those employers must provide unpaid Election Day leave to any employee who has been appointed as a precinct election official. To qualify, the employee must submit written documentation of their appointment at least seven days before the election. This provision helps ensure that polling places are adequately staffed while protecting the job security of employees who serve in that civic role.

Steps Employers Should Take Now

Review your current voting leave policy to confirm it meets Alabama’s requirements

If you operate in multiple states, audit your policies in each location

Train managers on employee rights under applicable voting leave laws

Communicate your notice requirements to employees ahead of Election Day

Confirm whether your workforce size triggers the precinct election official leave obligation

Questions about employment-related compliance or HR policy?
